Insight Mental Health Ltd is an independent mental care health provider, that is specialized in delivering high quality care in the mental health field.

What is a Privacy Notice?

A Privacy Notice is a statement issued by Insight Mental Health Ltd to people in general, informing on how we collect, use, maintain and disclose personal information gathered during our scope of practice. It applies to the information collected, the website, social media, by phone, by post, from anyone acting on your behalf, or during clinical interactions.

Different types of personal information collected

During our scope of practice we collect different types of information relevant to the service provided, such as:

  • Personal information: title, full name, age, date of birth, description of gender identification, nationality. Payment details used on the online applications GoCardless

  • Contact details: mobile number, email, address, NHS number, GP details

  • Professional information:

    • We will keep a record of all the contact that have been established with us through the different ways of communication (phone, email, post, contact forms)

    • Information obtained about the physical and mental health of the client, from different relevant sources (email, phone, post, forms, questionnaires, online assessments or in person)

    • Information that has been obtained through third parties such as other health related professionals, related to the client mental and physical health as well as personal circumstances

    • Information about any criminal convictions and offences, when considered to be relevant

Legal basis for processing personal information and the purpose of doing it

To be able to perform our work, we need to retain, process and share personal information of our clients. There are several laws that we comply with in order to process personal information. We follow the UK GDPR legal basis and exemptions, including the different articles of that same legislation.

We aim to process personal data with the view of:

  • To better support a decision-making process and improve the care delivered

  • To be able to comply with our scope of practice and insurance providers

  • To be able to establish, make and support possible legal claims (for example medico-legal reports)

  • To improve the clinical work delivered by our practice

  • To support our clients and others when we consider to be a risk to self or others and safeguarding need to be raised

  • To comply with any investigation regarding a complain, safeguarding concern, or regulatory body concern

Maintaining personal information

The personal information provided to us will be kept safe electronically. We are a paper free company and therefore no paper information will be hold.

All the personal information will be stored electronically on an external drive, password protected. Only clinical and administrative staff that require access to the personal information to perform their clinical work will have access to it. All professionals are aware of the duty of confidentiality and regulated by their own professional bodies. Any breach of confidentiality will be immediately investigated. We are registered with the Information Commissioner’s Office (ICO).

Withdrawing consent

At the time of contact and starting to work with our clinic, the clients will be asked to sign a consent to trat form as well as a sharing personal and clinical data form. This can be withdrawn or changed at anytime by contacting us directly and we will update our records accordingly.

Keeping your information

We held your information for the time required to support you and deliver the required care. The Common Law stated that the company is allowed to keep records for a period of six years. All the information will be electronically stored on a external hard drive password protected.

Your Access Rights

As a client you have rights regarding your personal information, which include:

  • To be clearly informed on how we store and process your information (privacy Notice)

  • To access your personal data (Subjects Access)

  • To request for your personal data to be rectified at anytime

  • To request erasure of your personal information (Right to be forgotten)

  • To be able to restrict processing, and therefore the right to request for the organization to stop processing or delete data if the client’s interest is superior to the company legitimate grounds

  • To be able to request for the personal data to be obtained and transited to organization (Right of Data Portability)

  • To be able to object from data being collected based on the public or legitimate interest (Right to Object)

  • Not to be subjected to automated decision-making and profiling

  • To have the right to complain to the Statutory Bodies

As a company we would like to inform that these rights are not absolute and we aim to inform you on how we will be able to comply with your requests regarding your access rights. If we’re unable to meet your request, we will inform you using correspondence, on the reasons why we’re unable to do so.

The current privacy note might be subject to changes and often we require to update them to reflect changes in the way we’re operating on in the law. Therefore, we support our clients to visit this privacy police whenever you contact us or visit our website.

Complaint or concern

If you would like to raise a complaint or a concern regarding the way we collect and use personal information, please do feel free to bring any concern to our attention.
